3. Directory Listings

Listings Are Not Endorsements

The inclusion of any business in our directory does not constitute an endorsement, recommendation, or guarantee of that business's qualifications, quality of service, or fitness for any particular purpose. We do not independently verify all information provided by or about listed businesses unless otherwise stated.

Featured and Sponsored Listings

Some directory listings are paid placements. These listings are clearly labeled as "Sponsored," "Featured," or "Paid Placement." Paid placement affects display position and visibility but does not affect editorial content, ratings derived from third-party sources, or our informational articles.

Accuracy of Listings

We make reasonable efforts to maintain accurate directory information but do not guarantee the accuracy, completeness, or timeliness of any listing. Business details such as addresses, phone numbers, service areas, and licensing status may change without notice. Verify critical details directly with the business.

Claiming a Listing

Business owners may claim their listing through our verification process. By claiming a listing, the business owner agrees to:

  • Provide accurate and current information
  • Not misrepresent their qualifications, licensing, or service area
  • Comply with all applicable laws and professional regulations
  • Not use the listing for deceptive or misleading advertising

We reserve the right to remove or suspend any listing that violates these Terms or applicable law.

4. Lead Generation and Forms

How Forms Work

When you submit a form on our Site (such as a quote request), your information is shared with the home service contractors described in the consent language accompanying the form. You must affirmatively provide consent before your information is shared.

Your Consent

Lead form submissions require your express written consent via an unchecked checkbox. The consent language specifies:

  • Who may contact you and how many service providers may receive your information (up to four)
  • How you may be contacted (phone, email, text), including via automated technology
  • That consent is not a condition of any purchase or service
  • That you may revoke consent at any time

No Guarantee of Service

Submitting a form does not guarantee that you will be contacted, that any contractor will be available for your project, or that any particular outcome will result. We act as a connection service, not a home service provider.

Revoking Consent

You may revoke consent to be contacted at any time by emailing privacy@callthelocal.com with the subject line "Revoke Consent." Previously shared information cannot be recalled from providers who already received it.

5. User-Submitted Content

By submitting User Content, you represent and warrant that:

  • The content is accurate and not misleading
  • You have the right to submit the content and it does not infringe any third party's rights
  • The content does not contain unlawful, defamatory, harassing, or obscene material
  • The content complies with all applicable laws and regulations

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, modify, and distribute the content in connection with operating the Site. We reserve the right to remove any User Content that violates these Terms, without notice.

Call The Local, CallTheLocal.com, and the Call The Local logo are trademarks or trade names of Vyze Media. You may not use these marks without our prior written permission.

If you believe content on the Site infringes your copyright, please send a DMCA takedown notice to privacy@callthelocal.com.

7. Prohibited Uses

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation
  • Submit false, misleading, or fraudulent information through any form
  • Attempt to gain unauthorized access to any part of the Site, its servers, or its databases
  • Use automated tools (bots, scrapers, crawlers) to access, collect, or harvest data from the Site, except as permitted by our robots.txt

You agree to indemnify, defend, and hold harmless Vyze Media, its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, your violation of any third party's rights, any User Content you submit, or any dispute between you and a service provider connected through the Site.

11. Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles.

Informal Resolution First

Before initiating any formal dispute resolution, you agree to contact us at privacy@callthelocal.com and attempt to resolve the dispute informally for at least 30 days.

Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator's decision shall be final and binding.

Class Action Waiver

YOU AND VYZE MEDIA AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. NEITHER PARTY MAY BRING CLAIMS AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

12. Modifications to These Terms

We may update these Terms at any time. When we make material changes, we will revise the "Last Updated" date and may post a notice on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

13. Termination

We reserve the right to suspend or terminate your access to the Site at any time, for any reason, without notice. Sections 6, 8, 9, 10, 11, and 14 survive termination of these Terms.

14. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy and Disclosures page, constitute the entire agreement between you and Vyze Media regarding the Site.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.
  • Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: We may assign our rights and obligations under these Terms. You may not assign yours without our written consent.
